Apportionment of the Rent charge in lieu of Tithes in the Parish of Saint Brides Super Ely in the County of Glamorgan

Whereas an Award of Rent charge was on the thirty first day of July in the year of our Lord one thousand eight hundred and thirty nine confirmed by the Tithe Commissioners for England and Wales of which Award with the Schedule thereunto annexed the following is a copy

Know all men by these Presents

Whereas I John Johnes have been duly appointed and sworn an Assistant Tithe commissioner (according to the provisions of the Act for the Commutation of Tithes in England and Wales) and have been also duly appointed to ascertain and Award the Total Sum to be paid by way of Rentcharge, instead of the Tithes of the Parish of Saint Brides Super Ely in the County of Glamorgan and

Whereas I have held divers meetings in the said Parish touching the matter aforesaid of which meetings due notice was given for the information of the Landowners and Titheowners of the said Parish and

Whereas I have duly considered all the Allegations and proofs tendered to me by all parties interested and have myself made all enquiries touching the premised subject which appeared to me to be necessary and

Whereas I find that the Lands in the Schedule hereunder written or hereunto annexed mentioned are covered from payment of Agistment Tithes and from render of certain Tithes in Kind by certain prescription or customary payments as therein specified and

Whereas I find that all the Woodlands of the said Parish are by prescription or other lawful means absolutely exempt from payment of all Tithes and

Whereas I find that the estimated Quantity in Statute measure of all the Lands of the said Parish which are subject to the payment of Tithes is as in the said Schedule mentioned and

Whereas I have estimated the clear annual value of the said Tithes in the manner directed by the said Act of Parliament and have also taken into account the Rates and Assessments paid in respect of such Tithes during the seven years of Average prescribed by the said Act and

Whereas I find that the Rector of the said Parish for the time being is entitled to all the Tithes thereof

Now Know Ye that I the said John Johnes do hereby [sic] award that the annual sum of one hundred and four Pounds by way of Rentcharge subject to the provisions of the said act shall from the first day of January next following the confirmation of the Apportionment of the said Rent Charge be paid to the Rector of the said parish for the time being instead of all the Tithes arising from all the Lands of the said Parish (except such Pasture Lands as may at any time be in the occupation of any person or persons residing without the Limits of the said Parish and except also the Glebe) and that the further sum of six pence for each and every acre of Pasture Land and a proportionate sum for any Quantity less than an acre now in or hereafter coming into the occupation of any person or persons residing without the Limits of the said Parish and not being an Inhabitant thereof shall be annually Paid to the Rector for the time being Subject to the provisions aforesaid by person or persons occupying the same as an additional Sum by way of Rent Charge in lieu of the Tithes arising from all the Pasture Lands of the said Parish the payment whereof is not covered by the prescriptive or customary payment in the said Schedule first mentioned

And I do hereby further Award that the further sum of Four pounds shall be paid to the Rector for the time being by way of Rentcharge subject to the provisions aforesaid in lieu of the Tithes of all the Glebe Lands of the said Parish or a proportionate part of such last mentioned Rent Charge in respect of any of the said Glebe Lands which may at any time not be in the occupation of the Rector himself

In testimony whereof I have hereunto subscribed my hand this Fifteenth day of July in the year of our Lord one thousand eight hundred and thirty nine.

Schedule to the Above Award

The undermentioned Moduses or prescriptive or Customary payments are payable instead of the undermentioned Tithes of the said Parish and the undermentioned Lands and Tithes respectively are covered thereby

That is to say all the Lands of the said Parish now being in or hereafter coming into the occupation of the Inhabitants thereof except the Lands forming part of the Farm of Pencoedmarchon as hereinafter mentioned are covered from payment of all Agistment Tithes by the payment of the Annual Sum of one shilling for each acre of Pasture Land so occupied as aforesaid to the Rector of the said Parish The lands within the said Parish forming part of the Farm of Pencoedmarchon? situate in the several Parishes of Saint Brides Super Ely and Pentyrch and in the chapelry of Lanilterne of which the Most Noble John Crichton Stuart Marquis of Bute is the owner are covered from render of all Tithes both great and small in kind by the annual payment of Thirty shillings to the said Rector the Lands so covered from render of tithes in Kind contain by estimation

The Ancient Meadow Lands forming part of the farm of Henstaff in the herein first mentioned Parish of which John Thomas Esquire is the owner are covered from payment of the Tithes of Hay in Kind by the annual payment of two pence to the said Rector such Meadow Land contain by estimation

All the Lands subject to the payment of any kind of Tithes within the said Parish of Saint Brides Super Ely contain by estimation Six hundred and thirty five acres two roods [sic] and twelve Perches and are cultivated as follows Arable

Now I Harry Phelps Goode of Saint Martins in the County of the Town of Haverfordwest having been duly appointed Valuer to apportion the total Sum awarded to be paid by way of Rent Charge in lieu of Tithes, amongst the several Lands of the said Parish of Saint Brides Super Ely

Do Hereby apportion the Rent Charge as follows: [blank]

Gross Rent Charge payable to the Titheowner in lieu of Tithes for the Parish of Saint Brides Super Ely in the County of Glamorgan (including Tithe of Glebe)

One hundred and eight Pounds

Value in Imperial Bushels and Decimal Parts of an Imperial Bushel of Wheat, Barley, and Oats.
